I purchased this item:

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&rd=1&item=8121670965&ssPageName=STRK:MEWA:IT

It is not what I consider in "like new" condition. The top edge has been sliced with a box cutter. It is not a "minor blemish". It is all the way through the leather to the interior "cardboard". The seller has offered to refund my money, less shipping. This is not functional and I do not believe that is fair. I am willing to pay shipping back to him. He has not left me feedback yet. I have very little (13) but all good. He has some negatives but I expect that with the number of total feedbacks he has.

Opinions? Here is my initial response I have not sent:

This is not what I consider "like new condition". This is also not a "minor blemish". The cut is all the way through the leather. This prevents this from being fully functional. Also, this damage was not enumerated separately in the auction. I am happy to pay shipping back to you. However, I would like a full refund of purchase price and shipping.

If the item was not properly described and you wouldn't have bought it if you'd know of the damage then I'd not only ask for a refund of puchase price + shipping, but also shipping back to him.

How about this:

This is not what I consider "like new condition". This is also not a "minor blemish". The cut is all the way through the leather to the inner core of the binder. This prevents this from being fully functional. Also, this damage was not enumerated separately in the auction. I am not happy with your offer.

Any need to go further to ask for the shipping specifically or just see what he offers?

Speaking as a seller I think you should just ask for the shipping both ways upfront. I think that it would save time and make your communication better.

Thanks for your input. I have emailed him what I posted a minute ago also asking, per his quoted business practices for shipping to be paid and refunded also. What sucks is I LOVE this binder. It is so supple and a gorgeous color. Oh well.
