Special Ed and Homeschooling

My oldest was placed in the gifted program after 2nd grade. She loved the program and wants to continue. I am planning to homeschool her and her siblings. DH wants her to continue in the gifted program. I am fine with that.

Does the school have a legal obligation, under IDEA or ADA to allow her to continue in these programs? I wouldl of course, be responsible for getting her there and back, that isn;t a problem. I have emailed both the teachers at her new school, and haven't hear back from them. I plan to cal the principal this afternoon if I still haven't hear from them.

Gifted education is not mandated, at least in my state(IL). In other words, the district would not obligated to allow her to continue. Not saying they wouldn't let her, but they are probably not obligated to.

Some states are mandated to provide gifted ed, but most are not mandated.
