Gov. Schwarzenegger has also come out on the side of the parents. He issued a statement that said, "Parents should not be penalized for acting in the best interest of their children's education. This outrageous ruling must be overturned by the courts and if the courts don't protect parent's rights then, as elected officials, we will."
i just saw that!!

This is the best news I've heard all day. I had a feeling this would be overturned. It's just too crazy to be legitimately upheld.

What a rollercoaster ride this has been! After seeing the testing of the waters in the arena homebirth midwifery, with it's mixed bag of acceptable outcomes in passed legislations with some states, I see the same testing of waters taking place in the arena of homeschooling. I'm glad to have two children finished with homeschooling, with my middle two finishing within the next 2-3 years, because the tossing of the judicial pebble into the pond of educational freedom, will have a continuing ripple effect for many years to come. Like KD said above, she will now have to defend her right to home educate her children, because the media will not recant it's statements. It doesn't take long for one busybody bee to link up with another busybody bee, to produce several hives worth of busybody bees. Even though there are homeschooling watchdogs working feverishly on getting this all straightened out, this situation will still have the potential to spread like wildfire. It just doesn't make sense to me that a judge can be so extreme in making a ruling like this, without there being a behind the scenes reasoning. No, I don't wear tinfoil hats, but I also don't buy into being innocent from the agenda's of others.
