The waistband doesn't have to go and I advise against doing it unless you really want it that way. *I* cut my waistband off because I wanted them to be drawstring in case I gain or lose weight, KWIM? But I had such a hard time with it that I gave up and put elastic which I absolutely hate. I made a pair for Kaylie and didn't take the waistband off and they're fine. If you aren't planning on taking the waistband off, I would definitely use a pair of jeans that are a size or two too small so that when you add the panel part to the waist, they aren't too big, KWIM? That's how I did Kaylie's. She had outgrown the pair that I used so I just added the amount of fabric on the panel that she needed to make them fit. I hope this makes sense, LOL.
